These Terms of Service ("Terms") govern your access to and use of everylittleseason.com and any purchase made through Every Little Season (collectively, the "Services"). By accessing the Services or placing an order, you agree to these Terms, our Privacy Policy, Return and Refund Policy, Shipping Policy, and any product-specific terms disclosed before purchase.

If you do not agree, do not use the Services. Nothing in these Terms limits a right or remedy that cannot lawfully be waived.

1. About Every Little Season and Shopify Collective

Every Little Season is the customer-facing online retailer for purchases made through this store. The store is hosted by Shopify. We curate and sell products supplied by independent brand partners, including brands connected through Shopify Collective.

For a Collective product, order information is routed to the applicable supplier brand, which generally holds the inventory, fulfills the order, and ships the product directly to you. Every Little Season manages the storefront, checkout relationship, customer communications, and coordination of eligible cancellations, returns, and refunds. We do not manufacture the products unless a product page expressly says otherwise.

Brand names, logos, product names, product imagery, and trademarks belong to their respective owners. Offering a brand's product does not transfer ownership of its intellectual property to Every Little Season or to you.

2. Eligibility and account responsibilities

You must be legally capable of entering a binding contract in your jurisdiction. If you use the Services on behalf of an organization, you represent that you have authority to bind it. You are responsible for the accuracy of information you provide and for keeping account credentials confidential. Notify us promptly of suspected unauthorized use.

3. Product information and availability

Product descriptions, photographs, dimensions, materials, care instructions, age guidance, warnings, inventory, pricing, and other listing information may be supplied or synchronized by the applicable brand. We work to present that information accurately, but colors and appearance can vary by screen, handmade or natural products can vary, and suppliers can update product information or availability.

Inventory is not guaranteed until an order is accepted and fulfilled. We may correct errors, update information, limit quantities, or cancel an affected item where information is inaccurate, inventory is unavailable, the destination cannot be served, or fulfillment would violate law or supplier restrictions.

4. Orders and acceptance

Your order is an offer to purchase. An automated order confirmation acknowledges receipt but does not guarantee acceptance or shipment. We may accept, reject, place on hold, or cancel an order for legitimate reasons, including suspected fraud, payment failure, inventory error, pricing or listing error, unsupported delivery location, quantity limits, safety concerns, or legal compliance.

If we cancel a paid item, we will issue the refund required by applicable law. Contact us immediately about requested changes. Orders route to suppliers quickly, so modification or cancellation is not guaranteed after submission.

5. Prices, payments, taxes, and promotions

Prices are shown in the currency displayed at checkout and can change without notice before purchase. You authorize Shopify and the applicable payment providers to charge the total presented at checkout, including shipping, taxes, duties, and other disclosed charges. You represent that you are authorized to use the selected payment method.

Discounts and promotions are subject to their stated terms, can be changed or ended where permitted by law, and cannot be combined unless expressly allowed. Obvious pricing or technical errors may be corrected. If an error affects a completed order, we may contact you for approval of the corrected terms or cancel and refund the affected item.

6. Shipping, fulfillment, and delivery

Independent brands generally fulfill and ship their own products. Items from different brands may ship separately with different carriers, rates, processing times, delivery estimates, and tracking numbers. Supplier shipping rates and available services are presented at checkout.

Delivery dates are estimates unless expressly guaranteed. Address accuracy is your responsibility. Shipping delays, unavailable items, lost or damaged shipments, customs, and cancellation rights are addressed in our Shipping Policy. If a promised shipping time cannot be met, we will provide any notice, cancellation option, and refund required by applicable law.

7. Returns, refunds, and cancellations

Returns, refunds, exchanges, non-returnable items, cancellations, and damaged-product claims are governed by our Return and Refund Policy. Contact Every Little Season before sending any item back. Different brands can require separate return labels and destinations. Sending a product without authorization can delay or prevent processing.

8. Product safety, instructions, and recalls

Read and follow all manufacturer instructions, warnings, age and weight limits, fit guidance, care directions, and recall notices before use. Inspect products before each use, use appropriate adult supervision, and stop using any product that is damaged, recalled, improperly fitted, or being used outside its intended purpose.

Baby carriers and other child-safety products must be used exactly as directed by the manufacturer. Educational content on our website or linked resources is general information and is not medical advice, a diagnosis, or a substitute for product instructions or individualized assistance from an appropriately qualified professional.

Contact us promptly if you learn of a safety problem, missing instruction, suspected defect, or recall involving a product purchased here. We will coordinate with the applicable brand as appropriate.

9. Brand warranties

A product may include a manufacturer or brand warranty described on the product page, packaging, or brand website. Any such warranty is provided by the identified brand under its terms. We can help route a warranty inquiry but do not create or expand a brand's warranty. This section does not limit warranties or remedies imposed by law.

10. Privacy and supplier data sharing

Our Privacy Policy explains how personal information is collected, used, disclosed, and protected. To process a Collective order, we share the information reasonably necessary for fulfillment and support—such as your name, contact details, shipping address, purchased items, and order status—with Shopify, the applicable supplier brand, payment providers, carriers, fraud-prevention services, and other service providers.

11. Reviews, submissions, and feedback

If you submit a review, image, comment, testimonial, suggestion, or other content, you represent that you have the necessary rights and that the submission is accurate, lawful, and does not violate another person's privacy or intellectual-property rights. You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, and distribute the submission in connection with operating and promoting the Services, subject to applicable privacy law.

We may moderate or remove submissions that violate these Terms, but we are not obligated to publish or retain any submission. Do not submit confidential information through public features.

12. Acceptable use

You may not use the Services to violate law; infringe intellectual-property, privacy, or publicity rights; transmit malware or harmful code; scrape or access the Services through unauthorized automated means; interfere with security or operation; impersonate another person; submit false payment or order information; commit fraud; harass others; or purchase products for unlawful use.

13. Intellectual property

The Every Little Season name, original site design, text, graphics, organization, and other content we own are protected by applicable intellectual-property laws. You may use the Services for personal, non-commercial shopping purposes. No other license is granted except as expressly stated.

14. Third-party services and links

The Services may link to or integrate with Shopify, supplier brands, payment providers, carriers, social networks, and other third parties. Their services are governed by their own terms and privacy notices. We are not responsible for an unaffiliated third party's website or independent conduct, but this does not limit responsibility that applicable law places on us for the transaction made through our store.

15. Disclaimer of warranties

To the fullest extent permitted by law, the Services are provided on an "as available" basis. Except for express written warranties and non-waivable legal guarantees, we disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise uninterrupted or error-free website operation or that every supplier will always meet an estimate.

16. Limitation of liability

To the fullest extent permitted by law, Every Little Season and its owners, personnel, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, data, goodwill, or business opportunity arising from use of the Services.

To the fullest extent permitted by law, our aggregate liability arising from a claim relating to an order will not exceed the amount you paid us for the product giving rise to the claim. These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury caused by legally actionable conduct, or any liability or consumer remedy that cannot lawfully be excluded or limited.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold Every Little Season harmless from third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, violation of these Terms, infringement of another person's rights, or misuse of a product contrary to clear instructions or warnings. This obligation does not apply to the extent a claim results from our own negligence, willful misconduct, or legal responsibility.

18. Suspension and termination

We may suspend or terminate access to the Services where reasonably necessary to protect customers, suppliers, the store, or others; investigate suspected fraud or abuse; enforce these Terms; or comply with law. Provisions that by their nature should survive termination will survive.

19. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to any non-waivable right to bring a claim elsewhere, disputes will be brought in the state or federal courts serving San Diego County, California. Before filing a claim, you and Every Little Season agree to make a good-faith effort to resolve the issue by contacting the other party.

20. General terms

If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent; we may assign these Terms in connection with a business transfer. These Terms and the policies incorporated above form the entire agreement concerning the Services unless a separate written agreement applies.

21. Changes to these Terms

We may update these Terms to reflect changes in the Services, supplier relationships, law, or business practices. Revised Terms will be posted with an updated date, and additional notice will be provided when required by law. Changes do not retroactively reduce rights that already vested under an accepted order.
